These Terms of Service (“Terms”) govern your access to and use of the Switchline AI dispatcher service, website, and dashboard (the “Service”), provided by Switchline LLC (“Switchline, ” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Switchline answers phone calls on your behalf using an automated AI dispatcher, and, depending on your plan, captures messages, schedules appointments, and sends you transcripts and summaries. Features and plans may change over time.
You must be at least 18 years old and able to enter into a contract to use the Service. You agree to provide accurate information, keep your login credentials secure, and are responsible for activity under your account.
The Service may record, transcribe, and respond to calls and may send text or email notifications. You are responsible for using these features in compliance with all applicable laws, including laws governing call recording, caller notice and consent, and automated or marketing communications. You represent that you have all rights and consents needed for the calls and contact information you route through or provide to the Service.
The Service integrates with third-party platforms you choose to connect, such as calendar and field-service providers. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for them. You are responsible for maintaining the rights and permissions needed for any integration you enable.
If your plan includes fees, you agree to pay them as described at sign-up or in your order. Unless stated otherwise, fees are non-refundable, and usage above your plan’s included amounts may incur additional charges. We may change pricing on a prospective basis with notice.
We own the Service and all related software, content, and trademarks, except for the data you provide. You retain your data, and you grant us the rights needed to operate the Service and provide it to you.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. The Service uses automated AI systems that can make mistakes, misunderstand callers, or miss calls; it is not a substitute for professional judgment, and we do not guarantee that every call will be answered, handled correctly, or scheduled. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Switchline LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.
You agree to indemnify and hold Switchline LLC harmless from claims, damages, and expenses arising out of your use of the Service, your content or calls, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
